A VIOLAÇÃO DO PRINCÍPIO DA LEGALIDADE FRENTE À INDETERMINAÇÃO TEMPORAL DAS MEDIDAS DE SEGURANÇA

Resumo

Este artigo tem por finalidade tratar sobre a possibilidade de violação do princípio da legalidade em virtude da aplicação de medidas de segurança por prazo indeterminado. Durante o estudo, foram abordadas considerações gerais sobre o princípio da legalidade e também sobre as medidas de segurança, buscando uma análise crítica e fazendo referências à bibliografia sobre o assunto. Ademais, também foram expostas as normas sobre as medidas de segurança no Brasil e na Argentina, a fim de compreender como os dois países tratam legalmente este tipo de sanção penal.

ABSTRACT

This article aims to discuss the possibility of violation of the principle of legality under the application of security measures for an indefinite period. During the study, they were addressed general considerations concerning the principle of legality and on the security measures, seeking a critical analysis, making references to the literature on the subject. Moreover, they were also exposed the rules on security measures in Brazil and Argentina in order to understand how the two countries legally treat this type of criminal sanction.
