ESTADO TÓXICO

Resumo

El presente trabajo es un análisis del Estado de la posmodernidad, cuya conformación tiene la finalidad de limitar al poder político, para que sea la mejor fórmula de la convivencia de los hombres en sociedad, y que se ha situado en crisis. Hoy pareciera que es un tóxico, como aquellos productos que causan alteraciones a los órganos de los seres vivos. Esta alteración perjudica a su propia población, y es indiferente a las necesidades de la ciudadanía salvo que éstas sean útiles para justificar la existencia de sus propias instituciones; y para su supervivencia, ha inyectado el miedo en la población, con la finalidad de evitar cualquier sublevación, que es controlada con el hiper-consumo del mundo en que vivimos, haciendo uso de herramientas como la tecnología para vigilar a los ciudadanos y, en el peor momento de la historia de dicha tecnología, para cometer genocidios industrializados. En estos tiempos, con la presencia del derecho penal simbólico y la expansión de los delitos y las penas, es el Estado el q e inventa a los delincuentes, olvidándose de la vieja controversia respecto a si los delincuentes nacen o los crea la sociedad, por lo cual, para inventar a estos delincuentes, el Estado se ha convertido en una fábrica de leyes. Por todo ello, se puede denominar: Estado tóxico.

ABSTRACT

The present is an analysis of the State in postmodern times, with the intention of limiting the political power so that it becomes the best formula for men to coexist in society since such coexistence has made crisis. It may appear today to be a toxic substance, such as those that alter the organs of the living beings. This alteration damages its own population and is indifferent to the needs of the people, unless those needs are useful for the justification of its institutions; and for its own survival, it has injected fear into the people so as to avoid any attempt of rebellion, which is controlled by the hyper-consumerism of the world we live in and by the use of various tools such as the technology that monitors the citizens and, in the worst episode of the history of the referred technology, to commit industrialized genocides. In these times, with the symbolic presence of the criminal law and the expansion of the crimes and the punishments, the state becomes the inventor of the criminals, thus leaving and old controversy behind: are criminals born or made by society? For the state to be able to create criminals, the same state has become a Law factory. For all of the reasons expressed before, the state may be called: Toxic state.
