¿AUN UN ESPACIO DE LA RACIONALIDAD PARA LA OBEDIENCIA DEBIDA? DE SU CLÁSICA PROBLEMÁTICA AL ESTATUTO DE LA CORTE PENAL INTERNACIONAL

Resumo

El presente trabajo pretende ubicar el problema de la bondad o incorrección de la exigencia de responsabilidad penal em determinados supuestos que requieren una série de consideraciones respecto del sentido de trascendencia penal de la obediencia debida. Presenta así, la delimitación de la existencia de tal deber, como algo que por su turno se convierte en presupuesto. Trata de la tarea de insertar dicho problemá en las un ámbito más amplio de las discusiõnes jurídico-penales. A partir de estas reflexiones cuestiona tanto la especificidad del problema, como la consecuente necesidad de su existencia jurídica autónoma. Analisa por último la valoración del alcance que, tendrá el reglamento de la obediencia debida en el estatuto de la Corte Penal Internacional.

ABSTRACT

This work aims to focus on the problem of goodness or incorrectness of the requirement of criminal responsibility in certain cases which require a series of considerations concerning the criminal relevance of the due obedience. It therefore presents a delimitation of the existence of this duty, as something which for its part is converted into a presupposition. It addresses the task of including this issue in a wider scope of legal-criminal discussions. Based on these reflections, it questions both the specificity of the problem, and the consequent need for its autonomous legal existence. Finally, it analyzes the valorization of the extent that the regulation of the due obedience will have in the statute of the international criminal Court.
