O PODER ESTATAL: UMA SELEÇÃO (NADA) NATURAL

Resumo

Este texto busca fazer uma breve incursão pelo mundo da normatividade, trazendo algumas origens histórico-sociológicas do surgimento do poder, como elemento controlador da sociedade e da lei; como elemento normativo construído e aceito por este grupo. Analisa-se aqui como o Estado tem agido quando na figura de representante do povo e aplicador da violência simbólica, buscando manter harmonia nas relações sociais, além de demonstrar que, em que pese esse objetivo, há influência do elemento seletivo dentro desse processo; e verificar então quais seus reflexos, com destaque ao tratamento pertinente às crianças e aos adolescentes em situações de infrações à lei.

ABSTRACT

The text seeks to make a brief foray into the world of normativity, bringing some historical and sociological origins of the appearance of power, as are element that controls the society, and law, as a normative element built and accepted by this group. It is analyzed here how the State has acted as the representative figure of the people, and an applicator of symbolic violence, seeking to maintain harmony in the social relations, beyond of seek to demonstrate that, despite this goal, there is an influence of selective element inside this process and then verify what is your reflexes, especially the relevant treatment to children and adolescents in situations of violations of the law.
