A FUNÇÃO CRÍTICA DO BEM JURÍDICO SUPRAINDIVIDUAL FRENTE À INTERVENÇÃO PENAL

Resumo

O presente artigo versa primordialmente sobre a capacidade de rendimento da teoria do bem jurídico frente aos problemas surgidos no âmbito da contemporaneidade, mais especificamente sobre o potencial crítico do bem jurídico supraindividual. Inicialmente, aborda-se a questão sobre a legitimidade de alguns bens supraindividuais em conformar objetos dignos e carecedores de proteção penal. Nesse ponto, a Constituição mostra-se protagonista na tarefa de converter bens em verdadeiros bens jurídicos, reconhecendo sua imprescindibilidade à vida em sociedade e ao indivíduo. Em seguida, focaliza-se o cerne problemático da pesquisa, que se instala na possibilidade de tais bens manterem uma função crítica perante a intervenção penal, algo que requer o preenchimento de alguns requisitos. Faz-se, então, necessário perquirir sobre quais características devem revestir o bem jurídico supraindividual para que ele seja apto a operar tal função, analisando-se a possibilidade de sua manutenção como categoria crítica do direito penal.

ABSTRACT

This article analyzes the possibility of maintaining the concept of legal goods/interests as a critical category towards the criminal system, more specifically aiming the so-called collective legal goods/interests, which are known for having usually blurry concepts that make it difficult to determine the offense on each case. The article initially focuses on the legitimacy of new legal goods/interests that have risen in the context of contemporary society, questioning if they constitute actual collective legal goods; further on, the highlight is set on how to guarantee that the concept of legal good/interest is able to perform a critical function towards the criminal law. In other words, it’s pursued the identification of the characteristics that it should bare in order to constitute a category that is able to point out when the criminal intervention is or is not legitimate.
