CRÍTICA AO MODELO CONSTRUTIVISTA DE CULPABILIDADE DA PESSOA JURÍDICA

O presente artigo analisa criticamente a proposta construtivista de fundamentação para a culpabilidade penal de pessoas jurídicas, a partir de seus problemas político-criminais, dogmáticos e práticos, demonstrando a inviabilidade de sua adoção.

This paper examines critically the constructivist proposal of justification to the criminal guilt of legal persons, their problems in the fields of criminal policy, dogmatic and practical, demonstrating the infeasibility of its adoption.
