A RESPONSABILIDADE OBJETIVA DA PESSOA JURÍDICA PELA PRÁTICA DE ATOS DE CORRUPÇÃO: NORMA PENAL OU ADMINISTRATIVA?

Resumo

O presente ensaio se propõe a debater o novo modelo de responsabilização de pessoas jurídicas introduzido pela Lei n. 12.846/2013, conhecida como Lei Anticorrupção Empresarial, que instituiu o marco da responsabilidade objetiva da pessoa jurídica. Nesse contexto, cabe investigar se a norma é de natureza meramente administrativa ou se também há elementos de Direito penal material, bem como se esse modelo de responsabilização conflita com os parâmetros de culpabilidade fixados pela Constituição Federal. A conclusão a que se chega é que a resposta mais adequada para o tema da “culpabilidade da pessoa jurídica” não esteja no Direito Penal, mas antes no Direito Administrativo Sancionador, que dispensa os elementos antropomórficos daquele e admite soluções mais céleres e eficientes no combate à corrupção empresarial.

ABSTRACT

This essay aims to discuss the new liability model for legal entities introduced by the Bill n. 12.846/2013, known as Business Anticorruption Law, which established the framework of no-fault liability of the legal entity. In this context, we investigate whether the norm is of a purely administrative nature or if there are elements of criminal material law, and if this accountability model conflicts with the culpability of parameters set by the Constitution. The conclusion reached is that the most appropriate response to the issue of the “culpability of the legal entity” is not in the Criminal Law, but before in the Administrative Sanctioning Law, that dispenses the anthropomorphic elements of the first one and allows more rapid and efficient solutions in the fight the corporate corruption.
