INTERSECÇÕES ENTRE PSICOLOGIA FORENSE E DIREITO PENAL: ENTRE LOUCOS E CULPÁVEIS

Resumo

O presente artigo busca demonstrar que o afastamento entre o Direito penal e a psicologia forense, ocorrido do fim do século XIX até a década de 1970, não inibiu práticas abusivas e embasadas em justificativas pseudocientíficas que tinham o fito de atingir com aumento/incremento de pena os alvos do sistema penal, dentre os quais estão os inimputáveis, os semi-imputáveis, os adictos em drogas e os traficantes, pontualmente tratados neste trabalho. Demonstra-se que a política-criminal desenvolveu-se e ainda se desenvolve, inclusive com base nos trabalhos de neurociências, no sentido de utilizar indevidamente o sistema penal para situações que demandam abordagens clínico-sanitárias, seja através da imposição de medidas de segurança sem relação com a condição psíquica do agente e por tempo indeterminado, ignorando-se o princípio da culpabilidade e a essencialidade do sistema vicariante, seja através da imposição de pena de modo a privar de liberdade certos grupos cuja aniquilação é o fim principal.

ABSTRACT

This article intent to demonstrate that the clearance between the criminal law and forensic psychology, used from the end of the 19th century until the 1970, not inhibited abusive practices and based on pseudo-scientific justifications that had the aim to achieve with feather increasing targets of the penal system, among which the not responsable people, the drug addicts and traffickers, promptly treated. Demonstrates that the criminal policy developed and still develops, including on the basis of the work of neuroscience in order to use improperly the penal system for situations that require clinical health approaches, either through the enforcement of security measures unrelated to the mental condition of the agent and indefinitely, ignoring the principle of culpability and the essentiality of vicariance system, either by imposing penalty in order to deprive of freedom certain groups whose annihilation is the main purpose.
