APONTAMENTOS SOBRE A RESPONSABILIDADE CRIMINAL DO AGENTE INFILTRADO POR DELITOS PRATICADOS EM CONCURSO COM MEMBROS DA ORGANIZAÇÃO INVESTIGADA

Resumo

O presente artigo situa-se em apenas um aspecto do multifacetado instituto da infiltração de agentes policiais em organizações criminosas. Inicia-se pela delimitação de tal ponto que reside na responsabilização do agente infiltrado pela prática de delitos em concurso de pessoas com membros da organização por ele investigada. Nesse aspecto, procura-se, a partir da análise das hipóteses de autoria e participação, definir os limites de afastamento da responsabilidade penal em tais casos.

ABSTRACT

The present article focuses on a single aspect of the multifaceted institute of the criminal organizations infiltration by police officers. It starts by delimiting the responsibility of the infiltered agent for commiting crimes in concursus deliquentium along with members of the investigated criminal organization. In this sense, one seeks to define, by analyzing the hypothesis of authorship and accomplice, the limits to criminal responsibility in such cases.
