O “CRIME” DE PEDERASTIA OU OUTRO ATO DE LIBIDINAGEM DO ART. 235 DO CÓDIGO PENAL MILITAR: REFLEXÕES SOBRE A (I)LEGITIMIDADE DO BEM JURÍDICO PROTEGIDO

Resumo

No presente artigo, o autor procede uma análise do art. 235 do Código Penal Militar (CPM), o qual será objeto de exame de constitucionalidade pelo Supremo Tribunal Federal (STF) quando do julgamento da Arguição de Descumprimento de Preceito Fundamental (ADPF) 291. Inicialmente são trabalhados os elementos do tipo do art. 235, a rigor: quais condutas podem ser consideradas ato libidinoso e quais são os locais que podem ser considerados como sujeitos à administração militar. A seguir, parte-se em busca da identificação do bem jurídico tutelado pela norma. Nesse ponto, verificou-se que a doutrina pátria e os julgados se dividem, ora indicando a disciplina militar, ora indicando a ética/moral militar como o objeto de proteção da norma. Em linhas conclusivas, resta assentado que, qualquer que seja a resposta, o art. 235 do CPM permanece revestido de ilegitimidade substancial de acordo com os critérios da dogmática penal contemporânea.

ABSTRACT

In the present article the author makes an analysis of article 235 of the Brazilian Military Criminal Code, which will be the subject of examination of constitutionality by the Supreme Court at ADPF 291 trial. Initially elements of article 235 type are worked, strictly speaking: what conduct may be considered a lecherous act? and; which are sites that can be considered as subject to military administration? Further on, one goes in search of the identification of the legal interests protected by the standard. At this point, it was found that the homeland doctrine and trial results are divided, sometimes indicating the military discipline, sometimes indicating the ethical/moral military as the subject of protection of the standard. In conclusion lines, it remains agreed that, whatever the answer, the article 235 of the Brazilian Military Criminal Code remains covered with substantial illegitimacy according to the criteria of the contemporary criminal dogmatic.
